Status: draft. Not legal advice. These terms were written against what the software actually does. They have not been reviewed by a lawyer, several clauses depend on choices you have not made yet (entity, jurisdiction, licence), and the placeholders marked […] must be filled in before publishing.

1. Agreement

By installing or using Nightjar Browser ("the Software") you agree to these terms. If you do not agree, do not install or use it.

There is no account and no registration. Your agreement is signalled by use.

2. Licence to use

Subject to these terms, you are granted a personal, non-exclusive, non-transferable licence to install and use the Software on devices you control.

[If the source is released under an open-source licence, that licence governs the source code and this section must be reconciled with it. No LICENSE file exists in the repository yet — see the note at the end of this document.]

You may not: remove or obscure notices; use the Software to break the law; or represent the Software as your own product.

3. No warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

In particular, and without limiting the above, no warranty is given that:

4. The AI assistant

The assistant runs a local language model. Language models produce confident text that is sometimes wrong. Output may be inaccurate, outdated, biased, or fabricated, and must not be relied on for medical, legal, financial, or other professional decisions. You are responsible for checking anything you act on.

The assistant can, at your instruction, read the page you are viewing, act on your behalf in the browser, and write text into form fields. You are responsible for what it does under your instruction, including anything it submits.

5. Third-party components and content

The Software downloads and runs third-party components, at your request:

We do not publish, endorse, or take responsibility for these, or for any website you visit through the Software.

6. Content blocking

The Software blocks advertising and tracking requests by default. This may breach the terms of service of some websites, may cause sites to malfunction, and may deprive publishers of revenue. You choose whether to run it, and you accept that responsibility. Blocking can be disabled globally or per site.

7. Acceptable use

You must not use the Software to access material that is illegal where you are, to attack or disrupt any service, to circumvent access controls you are not entitled to bypass, or to automate activity on a website in breach of that site's terms.

8. Limitation of liability

To the maximum extent permitted by law, in no event shall the authors or copyright holders be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the Software or its use — including loss of data, loss of profits, business interruption, or the consequences of anything the AI assistant produced or did.

Where liability cannot lawfully be excluded, it is limited to the amount you paid for the Software, which for a free distribution is zero.

Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

9. Privacy

See PRIVACY.md. In summary: the Software has no servers and collects nothing.

10. Updates

Update checks run only when you ask for them. You choose whether to install any update. Old versions may stop working with third-party services without notice.

11. Termination

This licence ends if you stop using the Software or breach these terms. Delete the application and its data folder to remove it entirely.

12. Changes to these terms

These terms may change; material changes will be noted with a new date. Because there is no account, there is no way to notify you individually. Continuing to use the Software after a change means accepting it.
